Dennis Maxim, Sgt. Maldonado and other unidentified officers searched Plaintiffs' home and allegedly found a weapon in a male's bedroom. The officers claim that Plaintiff consented to the search, but Plaintiff was incapacitated at the time and was not able to consent. \n\nWhile at the precinct, Plaintiff informed officers that she needed medical attention, but the officers ignored her, resulting in the Plaintiff passing out. After approximately 48 hours in custody, Plaintiffs were arraigned and released. Plaintiffs appeared in court approximately 10 times, and a grand jury ultimately refused to indict. Several NYPD Officers, including Defendant Officers Cruzbaez, Maxim, Chau, Schillinger, Izzo and Bistany, were on the scene and threw Plaintiff Acevedo to the ground, despite him having no affiliation to the fight. The officers hit Plaintiff Acevedo, breaking his glasses. One of the Defendants pepper-sprayed Plaintiff Santiago and threw him against a parked car. Both Plaintiffs were placed in handcuffs, and Defendants continued to strike Plaintiff Acevedo, who sustained injuries to his chest and face. Plaintiff Acevedo's requests for medical treatment were denied. After being transported to the precinct, the officers informed the District Attorney's office that they observed the Plaintiffs commit Obstruction of Governmental Administration, Resisting Arrest and Disorderly Conduct.
