Defendants ordered all occupants out of the vehicle and proceeded to search them and the vehicle. Defendants recovered no contraband from Plaintiff. Despite having no probable cause to believe that Plaintiff had committed any crimes or offenses, Defendants placed Plaintiff into handcuffs and under arrest. Defendants used excessive force in effectuating the arrest, namely by placing excessively tight handcuffs and refusing to provide Plaintiff with medical care despite Plaintiff's repeated requests. Plaintiff was subsequently transported to the police precinct where Defendants falsely informed employees of the New York District Attorney’s Office that they had observed Plaintiff commit various crimes and offenses when in fact Defendants did not observe Plaintiff violate any laws or ordinances. After attending all required Court appearances, all charges against Plaintiff were dismissed on or about November 22, 2021. Plaintiff mcgee opened the door and 2 cops asked if anyone rain into the apartment, to which Mcgee said no. The officers asked permission to search and Mcgee also said no. Plaintiff Dixon came home asked whats goin on. 15 minutes later more cops came and there was banging on the door. Mcgee opened the door and then the officers pushed it open, knocking Mcgee over. The officers did not have a warrant. Officers rushed in, handcuffed Plaintiff Ashley, put Plaintiff Mcgees hands behind her back, One officer handcuffed Dixon and patted him down. One Plaintiff, Bonilla was in the bedroom and was told to come out. A female officer serached Bonilla and handcuffed him. Plaintiffs Bonilla, Ashley and Dixon were arrested. Bonilla and Ashley were transported to the precinct and refused to thell them why they were arrested. At the precinct Bonilla was intrusively searched andtouched in the groin. Bonilla was held for 5 ahours in custody before being released with the Desk appearance Ticket to come to court. Ashely was searched at the rpcecint and also put in a holding cell for about 5 hours and was released with a Desk Appearance Ticket to answer the charge of trespassing. Dixon was searched in the apartment and outside the premises, but no contraband was found. Dixon was taken to the precinct and put in a holding cell and was searched. The sergeant told Dixon that they wont let him go if if he used the address of the apartment, and that he should use his mothers old address. After four hours Dixon was released from custody. While the plaitniffs were being held at the Precinct, Plaintiff Mcgeee came to the precinct to see what was going on and asekd why the other plaintiffs were being arrested. The officer said for trespass. Bonilla and Ashely came to court on July 29, 2014 and on July 10, 2014, the charges were dismissed against them. Dixon was issued a summons with the improper address.
