On the aforementioned date, the plaintiff was walking in the vicinity of Wilson Avenue and Green Avenue when a man grabbed her phone and attempted to steal it. One onlooker, a man named Charles, saw the altercation, called 911, and offered to drive the plaintiff home. As the plaintiff and Charles were driving in his car, several police officers responded to the 911 call. The plaintiff told one of the officers she did not want to file a police report. Subsequently, one of the officers asked Charles to exit his vehicle. Charles questioned this and refused to exit the vehicle. Instead, Charles and the plaintiff drove away. The defendants, Martinez and DeLeon, heard about Charles's departure over dispatch and pulled him over several blocks later. After Charles refused to stop his vehicle, the defendants rammed into the car three times. \"Ramming\" is prohibited by the NYPD Patrol Guide Procedure Np. 221 - 15. The defendants actions of unreasonably ramming into Charles vehicle caused injuries to the plaintiff's head, face, eye, neck, esophagus, trachea, and back. After Charles stopped his vehicle, he left the scene. Another NYPD Supervisor arrived at the scene and asked Defendants Martinez, DeLeon, and Doe why they did not halt their pursuit as instructed by the supervisor. The plaintiff heard this comment from the supervisor. Subsequently, the plaintiff was placed in restraints and transported to Brookdale Hospital. Further, the plaintiff could not have necessary surgery to her injured eye because the defendants would not remove her restraints. \n\nAs a result of the defendants' actions in ramming into a vehicle where the plaintiff was a passenger and denying her immediate medical care, the plaintiff sustained serious and permanent physical injuries.
