The defendant officers demanded that Ms. Acevedo accompany them to the 43rd police precinct for questioning. Ms. Acevedo asked if she was under arrest and one or both of the officers said not yet.  Ms. Acevedo asked if she could drive herself to the 43rd police precinct in the Bronx and was told that she could not drive herself to the precinct and must accompany the officer in their vehicle. Ms. Acevedo did not consent to being transported to the Bronx but under immense fear for her health and safety felt compelled to accompany the defendants to the Bronx.\n\nThereafter, Ms. Acevedo was taken to the 43rd precinct in the Bronx where she was placed in handcuffs without her consent. While at the 43rd precinct in the Bronx, the plaintiff was told by Defendant McHughs that she was being accused of stealing by Lawrence Boatwright.  Plaintiff immediately informed Det. McHughs that she had an active order of protection against Mr. Boatwright in Westchester County, New York, and the allegation by Mr. Boatwright was a fabrication to\nget revenge.  Detective McHughs left the room and return and told Ms. Acevedo that there is no order of protection and she is under arrest. Ms. Acevedo then gave Detective McHughs a letter from the Westchester County DA dated April 23, 2019 and a complaint slip evidencing that she had a complaint against Mr. Boatwright.  Det. McHugh placed a handcuff on Ms. Acevedo which were very tight around her wrist causing her substantial pain and suffering. Without probable cause the plaintiff Nanette Acevedo was detained for 10 hours or more at the 43rd precinct and central booking. Plaintiff Tyshawna Moore was present in the apartment during the foregoing events. She was subjected to multiple assault and batteries, including being handcuffed too tightly, in the course of her being arrested. Ultimately, Defendant Officers failed to locate anything illegal on Plaintiff Osworth's person or within his reach. Defendants, including McHugh, acting with malice, conveyed the aforementioned false, misleading and incomplete information to prosecutors in order to have Plaintiffs prosecuted.
