On their way to the store, Plaintiff and his friends passed by a group of people they did not know and a fight broke out among that group of individuals.  Plaintiff did not know the individuals and he was not involved in the fight. Mr. Gonzales-Lott was injured by some of the people fighting and received a cut to his face.  Plaintiff and his friends got into a car to drive to a local hospital, but were stopped by multiple police officers before arriving there. Plaintiff was not driving the vehicle. Police officers used their vehicle to illegally block the vehicle, and then handcuffed and frisked Plaintiff.   He was unlawfully placed in an NYPD vehicle and driven to a precinct. Once the defendant officers approached Plaintiff, he was not free to leave. The complaining witnesses were heavily under the influence of illegal drugs at the time of Plaintiff’s identification.  Defendant officers, including defendant officer Corlette, understood that complainants were not in a sound state of mind to make a reliable identification, but permitted the identification to continue. Plaintiff was detained at the 46th Precinct for several hours. During this time, the handcuffs on Plaintiff’s wrists and ankles were fastened in an extremely tight manner, causing Plaintiff severe pain.  Despite Plaintiff’s complaint and request to loosen the cuffs, defendant officers failed to do so. Despite being suffering injuries to his writs, Plaintiff was not offered medical care or taken to the hospital. Plaintiff was later transported to Bronx Central Booking. While plaintiff was incarcerated, defendants falsely and maliciously filed a complaint for Robbery in the Second and Third Degrees, Attempted Robbery, Grand Larceny in the Fourth Degree, Petit Larceny, Assault in the Third Degree., and Reckless Driving. Prior to the arrest, the plaintiff was brutally attacked by a male and female, one of whom slashed his face with a knife, causing a severe, bleeding wound. In fear for his life, the plaintiff fled the scene in a vehicle. Defendants pulled him over, observed his injury, and were informed by the plaintiff that he was fleeing from his assailants. Despite this, the defendants brought the assailants to the plaintiff’s location, where they admitted to slashing his face but falsely claimed the plaintiff had assaulted or robbed them. The defendants conducted an illegal search of the plaintiff, contorting his arms and applying excessively tight handcuffs. Those defendants present but not actively participating in the unlawful conduct failed to intervene. After the arrest, the plaintiff was taken to the 46th precinct, where he was fingerprinted, photographed, searched, and confined to a cell. He was then transported to Central Booking and subsequently to various buildings within the Rikers Island Correctional Facility, where he was subjected to assaults, batteries, searches, strip searches, and numerous other civil rights violations. The defendants fabricated evidence and falsely charged the plaintiff with assault and robbery. The plaintiff was wrongfully detained for over six months until all charges were dismissed in his favor.
