Plaintiff was entering the building to see his friend and his friend's grandmother who live in the building in apartment 6J. As he entered the lobby, Defendant NYPD Officer Myers ran toward him and grabbed his arm. Defendant Myers demanded to know where the Plaintiff was going and Plaintiff explained that he was there to see his friend and his friend's grandmother in Apartment 6J. Plaintiff even offered to take Defendant to the apartment to verify, but Defendant refused. Defendant then instructed Plaintiff to put his hands behind his back because he was under arrest and Plaintiff complied. Defendant proceeded to pat down and frisk the Plaintiff, but did not find any contraband. Plaintiff was taken to the Precinct for processing. Defendant Myers then searched the Plaintiff and recovered one small bag of marijuana from inside the Plaintiff's shoe. Defendant arrested Plaintiff for Unlawful Possession of Marijuana, Criminal Possession of Marijuana in the Fifth Degree, and Trespassing in the Second, Third, and Fourth Degrees.
