Plaintiffs had been sitting in the parking lot with the vehicle idling for approximately two minutes when they observed approximately six unmarked police vehicles pull into the parking lot. Approximately fifteen Defendant Police officers got out of the vehicles, approached Plaintiffs’ car and began banging on the windows and shouting at Plaintiffs with their weapons drawn. Defendant Police Officers opened the car doors, pulled Plaintiffs out, and slammed them up against the side of the vehicle. Defendant Police Officers began to unlawfully arrest Plaintiffs, restraining them with metal handcuffs and subjecting them to an unlawful pat-down search. Plaintiffs did not resist arrest and when Plaintiffs asked why they were being arrested, they were told by Defendant Police Officers that they had been sitting in a stolen car; the car was in fact legally owned by Plaintiff Gomes. Defendant Officers then placed Plaintiffs in the back of an NYPD vehicle and transported them against their will to the 71st Precinct, where they were unlawfully fingerprinted, photographed, searched, and placed in a holding cell. Plaintiff Cummings’ handcuffs were applied so tightly that his wrists began to bleed while he was in custody at the 71st Precinct. After approximately 24 hours at the 71st Precinct, Plaintiffs were transferred to Kings County Central Bookings. Defendant Officers falsely stated to the Kings County District Attorney’s Office that the plaintiffs were guilty of Obstructing Governmental Administration. After approximately 48 hours in custody, Plaintiff Cummings was arraigned in criminal court and released on his own recognizance. The charges against Plaintiff Cummings were thereafter dismissed. Then, without any reasonable basis or probable cause for doing so, police officers approached, stopped, searched and detained Plaintiff. The search yielded no evidence of any guns, drugs, or contraband, but the officers nevertheless arrested Plaintiff. Sergeant Rich arrived at the scene and supervised the arrest. Plaintiff did not know why he was being arrested, but while it was happening he overheard on the officers’ police radios that other members of the NYPD were apprehending, or had apprehended, other individuals in the area for gun possession, which Plaintiff would eventually be charged with. \n\nPlaintiff was transferred to a precinct where he was held for several hours. While at the precinct, officers Sargent, Riche and Bute subjected Plaintiff to excessive force by striking him on his face and body. The use of force lacked any justification. Plaintiff repeatedly requested medical attention for the injuries he incurred, including cuts and lacerations he sustained to his face, but the officers refused to provide medical attention. The officers assaulted, battered, and threatened Plaintiff, in order to coerce him into putting on a red sweatshirt and Cardinals baseball cap, which Plaintiff did not own, and which Plaintiff was not wearing that evening. Plaintiff was then transferred to Central Booking, where he was held for several more days before he was arraigned on a criminal complaint containing false allegations sworn to by officer Sargent. Officer Rich, officer Sargent’s supervisor, approved the arrest and paperwork related to Plaintiff’s arrest, and failed to prevent the illegal acts taken by his colleagues. Pursuant to the knowingly false allegations made by the officers, Plaintiff was charged with criminal possession of a weapon. Plaintiff was then transferred to Rikers Island, where he remained in custody for several more days.
