While M.V. was in the hospital waiting room, two men accosted him and told him to give them his phone. Hospital security intervened, along with NYPD defendant Valdez. Mr. Valarezo took his family outside in compliance with Valdez's orders. One of the men who accosted M.V. began making threatening gestures towards them, and Mr. Valarezo complained to the police officers about the man's actions. Someone believed to be Defendant Mullen put an arm across Mr. Valarezo's chest, which he brushed off. Defendants Doe violently threw Mr. Valarezo to the ground an dstruck him repeatedly in the face, torso, and head. One officer put his knee on Mr. Valarezo's head and ground his face into the concrete. M.V. rushed to his father, and officers grabbed M.V. and threw him to the ground. Defendants Doe kicked, punched, stuck, and choked M.V., and slammed his head into the ground. After handcuffing M.V., one or more of the “John Doe” officers pulled him up from behind, overextending his arms and causing unnecessary and intense pain. One or more Doe officers illegally searched M.V. and pulled his pants down in open view, as well as yelled and cursed at him. One or more John Doe officers slammed M.V.'s head into a police car. Defendant Mullen ordered Defendant Valdez and others to arrest Mr. Valarezo and M.V. with no probable cause. While yanking Mr. Valarezo up from behind while he was cuffed, one or more John Doe officers injured his shoulder. \n\nMr. Valarezo and M.V. were taken separately to the 44th Precinct. Mr. Valarezo was placed into a holding cell with other arrestees, which was exceedingly dangerous and deliberately indifferent to Mr. Valarezo’s safety because he could have been identified by another arrestee as a former Corrections Officer and assaulted. When M.V. was brought into the 44th Precinct, he was placed on a bench next to the man who tried to rob him. M.V. was taken into a room where he was handcuffed into the wall and questioned. Neither his parents nor any other family member was present during the questioning, nor did they consent to M.V. being questioned. While M.V. was detained, he did not have access to his epilepsy medication. He suffered at least one seizure inside of the precinct because of this. M.V. was never provided medical care at the 44th Precinct. Both Plaintiffs were charged with disorderly conduct under false allegations.
