After approximately 24 hours in custody, Plaintiff was arraigned as a result of the officers falsely telling the DA's office that Plaintiff committed a crime. Upon being released, Plaintiff went to the hospital to be treated for his injuries. Plaintiff missed three days of school as a result of the arrest. Defendants lacked probable cause, reasonable suspicion, valid search or arrest warrant, or any other legal justification. As plaintiff approached the front door to comply, defendants, including Officer Palminteri, violently kicked open the door, forcefully impacting plaintiff's head and causing significant injuries. Defendants proceeded to grab plaintiff about his head and body before unlawfully searching his person and personal belongings. Defendant-officers restrained plaintiff and applied excessively tightened metal handcuffs to plaintiff. Defendants ignored plaintiff's requests to loosen the handcuffs. Defendants' actions towards plaintiff were based on defendant's perception or consideration of Plaintiff's status as a Black or African American male. Defendants' actions towards plaintiff were pursuant a 'Quota' policy unlawfully employed by defendant-City of New York and NYPD. Defendants' excessive force was in retaliation for plaintiff's inquiry as to the motivation of defendants' course of conduct.\n\nPlaintiff was transported to a nearby hospital. There, plaintiff was treated for wound cleaning and stitches, due to defendants' excessive use of force. Plaintiff was transferred via police vehicle to the 79th Precinct. At the precinct, defendants unlawfully interrogated plaintiff without the presence of counsel or reading plaintiff his rights under Miranda v. Arizona. Defendants, including officer Palminteri, signed and forwarded criminal complaint, knowingly affirming the truth of fabricated allegations against plaintiff. Based on defendants' false statements, plaintiff was arraigned and charged with possession and sale of narcotics. On January 31, 2020, plaintiff was released from custody. After the plaintiffs were leaving a funeral together in Michael Thomas's vehicle, Thomas was pulled over by the defendant officers, who falsely claimed that Thomas had made an illegal U-turn. Upon being stopped, the officers ordered the plaintiffs out of the vehicle and searched the vehicle, as well as, the plaintiffs themselves. The officers then falsely claimed they had recovered firearms, one from within Thomas's vehicle and another from the person of Anthony Alston. The officers then arrested the plaintiffs with multiple charges of criminal possession of a weapon. Officer Palminteri signed off on the criminal complaints against each plaintiff, wherein he alleged that he had been informed by Officer Cooley that Cooley had recovered a loaded firearm from underneath the driver's seat of Thomas's vehicle. Plaintiff Kirkman was having people over to watch the NFL Playoffs. At half time, Plaintiffs left Kirkman's apartment to go to the store for refreshments. Defendant officers entered the lobby of the building and told the Plaintiffs they were trespassing. The officers did not allow Kirkman to get his identification to prove he lives in the building. The officers did not allow Plaintiff Taylor to show them that he was visiting his aunt's apartment. The officers grabbed all four Plaintiffs and placed them in handcuffs before taking them to the 79th Precinct and Kings Country Central Booking. Plaintiff Kirkman was released at Central Booking, but the other three Plaintiffs were held in custody for approximately 24 hours after the Defendant officers provided the District Attorney's Office with false, misleading, and/or complete information that the Plaintiffs committed trespass.
