The criminal proceedings against Plaintiff Milliner were brought out of actual malice and not to cover up the assault and battery, illegal imprisonment, illegal search and seizure and false arrest of the Plaintiff by Defendant Officer Magud. Despite being told that nothing was wrong, the officers allegedly assaulted and falsely arrested Mr. Holmes without cause. When Ms. Vazquez began recording the officers' conduct, Officer Majeed assaulted her, striking her in the face and falsely arresting her as well. Both plaintiffs were charged with resisting arrest, obstructing governmental administration, and disorderly conduct. The Bronx District Attorney declined to prosecute the charges.
