Plaintiff was informed that he was pulled over because a single air freshener was hanging from his rear-view mirror, which obstructed the Plaintiffs view. After about 30 minutes, PO Brites asked Plaintiff to walk towards the police vehicle so he could explain what was going on. PO Brites handcuffed Plaintiff and told Plaintiff he had a warrant for his arrest, while in reality no warrant for arrest existed. Plaintiff was charged with having inoperable rear license plate lights, although Plaintiff's rear license plate lights were operable, and having his view obstructed by a single air freshener hanging from his center rear view mirror, though the air freshener did not obstruct Plaintiff's view. With no probable cause, Plaintiff was arrested and held in jail for about 25 hours before being released from custody.
