Defendants intentionally provided false information that would be likely to influence a prosecutor's decision to charge Plaintiff with a crime or violation of the law so that a criminal prosecution would be initiated against McKenzie. John Doe #1 without any just or probable cause and without reasonable suspicion. At the time he was stopped, Mr. Ottey was breaking no laws and operating his vehicle in accordance with state and local traffic laws. The defendants, absent a warrant, probable cause, reasonable cause or any legal justification approached Mr. Ottey and searched, grabbed, assaulted, battered and detained him in an excessive manner. While in unlawful custody, Mr. Ottey was then subjected to a strip search. Mr. Ottey was then arraigned after his arrest and then falsely and maliciously prosecuted based on false and incomplete information provided by the defendants to District Attorney.\n\nThe defendants transported Mr. Ottey to the police precinct and caused him to have his fingerprints and photographs. Mr. Ottey remained incarcerated for a week \n at various police stations, correctional facilities, and at the Courthouse located at 215 East 161st Street, County of Bronx, without seeing a judge or magistrate and was deprived of adequate food and medical care. The prosecution against Mr. Ottey was dismissed and terminated in his favor on April 20, 2021.
