Several NYPD officers then approached Plaintiff, whereupon Plaintiff informed them of the situation. The officers arrested Plaintiff, notwithstanding the facts that he was not violent and that they had no probable cause to believe that Plaintiff had committed any crimes or offenses. Plaintiff offered no resistance. Shortly thereafter, angered by Plaintiff’s complaints that the officers had not apprehended the individual who had stolen his phone, the officers beat Plaintiff. PO Michael McManus used an asp and hit Plaintiff on the leg. \n\nOnce at the precinct, Plaintiff was placed in a holding cell. He complained that he was injured and needed attention. The officers then told Plaintiff to stop complaining. Plaintiff persisted in asking for medical treatment and demanded to know why he was arrested and beaten, whereupon PO Victor Whilchez pulled Plaintiff out of the cell and punched him in the face. Other officers from the precinct joined in the assault. Plaintiff thereafter again pleaded for medical attention, and was finally taken to the hospital. PO McManus and Whilchez falsely informed the DA’s Office that they had observed Plaintiff commit several crimes/offenses, in an effort to cover up their unlawful assault of him. After checking the identifications and asking several questions, Plaintiff was issued a ticket for driving through a red light. Plaintiff and his wife then drove away. Approximately one block later, officers pulled him over again. They approached Plaintiff's car with their guns drawn. Plaintiff was violently pulled from the driver's seat and assaulted by the officers. He was dragged, punched and kicked multiple times. He was struck several times with a police baton. Plaintiff was taken to the precinct handcuffed despite having committed no crime. He was then taken to the hospital where he was diagnosed with a facial fracture, abrasions to his face, arm, upper lip and lower left back. After he received treatment, he was taken back to the precinct, where he began to feel dizzy and collapsed into the bars of the jail cell. EMS transported him back to the hospital, where he was diagnosed with swelling to the top of his head. Plaintiff was charged with Assault in the Second Degree and other related charges. Eleven months later, all charges against Plaintiff were dismissed.
