Plaintiff approached a woman he knew to say hi and catch up. Soon after Defendant officers Samuel Lavaud, Nicholas Demetrius, Andre Grant, Paul Melendez and others (together the \"defendants\") pulled up and illegally stopped and threw plaintiff to the ground. They then falsely arrested him and placed him in their van. Defendants fabricated a story making false allegations against plaintiff including gun posession and maliciously prosecuted him. They falsely stated that they closely observed Mr. Parker when they arrived at the scene, that he dropped a firearm from his person, that he ran away, and that he resisted arrest. The Defendants testified falsely to these facts in the grand jury, and based upon this false testimony the Kings County District Attorney’s Office secured an indictment. Plaintiff was held incarcerated for two days post arraignment until he was able to make bail. Plaintiff was subject to the negligent and intentional infliction of emotional distress by the defendants. Defendants that were present but did not actively participate in the aforementioned incident failed to intervene to prevent the unlawful acts.
