Plaintiffs Bernard Gumbs and David Marrero were charged with \"acting in concert with each other\"—but not with any other persons—by shooting Tucker and Ford to death with a loaded firearm.  Plaintiffs were remanded to Rikers Island Correctional Facility.  Later  Christopher Sinclair was arrested in Bronx County for a firearms offense and was told that federal law enforcement had learned he committed the Tucker and Ford murders and that he was facing the federal death penalty.  Sinclair cooperated and admitted that he shot Tucker and Ford to death at the urging of Plaintiffs Gumbs and Marrerro. Four years after the indictment, on May 23, 2012, Plaintiff learned that the People now intended to prove that Sinclair was the shooter and that Gumbs and Marrero solicited him to commit the murders.  On June 8, 2012,  a written motion to dismiss the indictment was filed, claiming that the People were changing their theory of the case such that there was a \"material variance\" as Sinclair was the shooter and Gumbs provided him the pistol.  On October 1, 2012, Plaintiffs were acquitted of murder in the first degree and of murder in the second degree as to Monique Ford but were convicted of murder in the second degree as to Roderick Tucker and ultimately were sentenced to serve an indeterminate term of twenty-five (25) years to life.  In 2016 the convictions were overturned by Supreme Court Appellate Division.  After the Plaintiffs were re-tried twice and had to undergo numerous court appearances until June 2, 2023 when  their convictions were vacated and the entirety of the charges finally dismissed and Plaintiffs were released.
