After leaving the train, he saw a tow truck in the process of towing his vehicle. Defendant Richard Capuano, a New York City Marshal, asked plaintiff if the car was his; plaintiff asked why his car was being towed in response. Several of Capuano's employees and/or agents, exited the SUV and struck plaintiff in the chest causing injury. After Capuano and his agents left the scene plaintiff called 9-1-1. They knocked Plaintiff to the floor, pepper sprayed him and attempted to tase him. The taser did not penetrate Plaintiff’s sweatshirt, but the pepper spray rendered me temporarily blind and was extremely painful. Plaintiff spent approximately 20 days in incarceration on false charges.
