At a red light, DeJesus put on an NYPD windbreaker and demanded Plaintiff pull over, which he did. Without identifying himself as a police officer, DeJesus requested vehicular paperwork. Unconvinced, Plaintiff began to drive away, and DeJesus claimed Plaintiff drove over his foot. A police van arrived, and officers Fisch, Nunez, and Samuels arrested and handcuffed Plaintiff, ignoring the lack of danger to DeJesus. Plaintiff was taken to the 78th Precinct, where Defendant Fisch filed several misdemeanor charges against him, including assault and reckless endangerment. Plaintiff was released on his own recognizance after 36 hours, and all charges were dismissed in his favor on November 21, 2011.
