MARTIN (Shield 16213), PEDRO RODRIGUEZ (Shield 28987), and DENNIS HOE (Shield 3915). After Plaintiffs were ordered out of the vehicle and Andujar was immediately placed in handcuffs, the officers conducted a warrantless search of the vehicle, which included a search of Edelstein's closed school bag where the officers allegedly found a police placard. Both Plaintiffs were then arrested and transported to the 72nd Precinct with Officers MARTIN and HOE falsely claiming that they observed marijuana in a ziplock bag and a gravity knife in plain view inside the vehicle. While at the 72nd Precinct, Edelstein was subjected to repeated inappropriate statements and ridicule. Officer RODRIGUEZ allegedly asked Edelstein, \"What's up with the weed? ... I know it's your boyfriend's ... you like dating criminals? ... no Spanish kid that age carries that kind of money.\" After asking for Edelstein's social media account, RODRIGUEZ also stated, \"Don't worry... a pretty, little rich girl like you doesn't need to cry, daddy will come fix this mess.\" Both Plaintiffs were then transported to Central Booking and arraigned around 11:20-11:50pm the same day (July 14). Officer MARTIN falsely claimed that the placard found in Edelstein's bag was found on the floorboard and that Andujar was in possession of marijuana that was also found on the floorboard. All charges against the Plaintiffs were eventually dismissed. \n\nThen on December 11, 2016, at approximately 1:40am, officer RODRIGUEZ, who has a history of improper conduct (see Morales v. RODRIGUEZ, 14 CV 4911 assault and battery; Webb v. City of New York, 08 CV 5145 assault and battery of a grandmother; Shears v. City of New York 08 CV 4832 excessive force), stopped Edelstein while she was operating her car in the same location as the previous incident. Edelstein was stopped at a light directly behind an unmarked police vehicle. When the light turned green but the vehicle in front of her did not move, Edelstein honked her horn. At that point, RODRIGUEZ emerged from the vehicle, demanded Edelstein's license and registration and then ordered her out of the vehicle. When Edelstein refused, RODRIGUEZ walked back to his car while another unidentified officer approached Edelstein, shined a flashlight into her vehicle and then walked away. Plaintiff was outside talking on the phone when the police approached, grabbed, punched, and handcuffed plaintiff and threw him to the ground. As a result, the plaintiff had his face, wrist, back, hip, knee and shoulder injured.
