Within five minutes of plaintiff's arrival, defendant-officers, including officers Peter Ramos (Shield No. 12134), Sergeant Kitwane Lewis , Ryon Malcolm, Michael Landi (Shield No. 762), Maximo Perezcoyloe (Shield No. 222) and Kanesha Smith (Shield No. 12210), aggressively knocked down the residence's door and alleged they were executing a search warrant targeted at plaintiff's friend's half-sister. This person was not present at the time of the defendant-officers' arrivals. Defendants immediately searched plaintiff's person and handcuffed person. Plaintiff cooperated with defendant, informed defendants of his reason for being present at the residence, and provided defendants with his identification showing a separate residential address. Defendants proceeded to search the residence, alleging recovering firearms and contraband; each of these alleged items were concealed. Defendant-officers arrested plaintiff without probable cause or legal justification. Defendant-officers dragged plaintiff out of the apartment and into a common elevator, wherein they forcefully pushed plaintiff with their elbows in his back and ribs. \n\nPlaintiff was transported and processed at the 88th Precinct, wherein he was interrogated about his presence in the residence and knowledge about the alleged contraband recovered. Plaintiff cooperated with defendant-officers and submitted to a DNA sample. During this time, defendants seized plaintiff's cellular phone; defendants have not returned plaintiff's property. Defendants advocated for criminal prosecution. Plaintiff was subsequently transferred to Central Booking. Plaintiff was not arraigned until 37.5 hours after plaintiff's initial arrest. Plaintiff was unable to post bond. Plaintiff remained in New York City custody until May 21, 2020. While in custody at the Manhattan Detention Center, plaintiff was assaulted by two inmates. Present DOC staff responded by spraying the plaintiff and his assailant with chemical agents, causing burning and precipitating an asthma attack.
