None of the arrests were made pursuant to a warrant. On October 15, the Plaintiff participated and helped lead a protest march and stayed on the sidewalks throughout the march. The police officers present encouraged the Plaintiff to keep the marchers. . . . Nonetheless, Defendant officer Curley arrested the plaintiff and charged him with Penal Law 240.20(5) and (6). In the criminal complaint, Curley falsely claimed the Plaintiff repeatedly entered the street, caused public inconvenience and annoyed and alarmed pedestrians on the sidewalk who were not part of OWS. On October 26, 2010, Officers Waring and McNamara arrested the Plaintiff during a march where the plaintiff was again on the sidewalk. With no order to disperse from the sidewalk, the officers grabbed the Plaintiff, pulled him to the ground with his face in the sidewalk and placed flexicuffs on him. Officer Waring arrested him and falsely stated in the complaint that the plaintiff was part of a group that blocked traffic. The charges in each both instances were later dismissed.\n\nOn Nov. 8, 2011, the Plaintiff was participating meetings in Zucotti Park. Police stopped him while he was crossing the street and ordered to stand behind the metal barriers, which he did. Later, he learned that there was allegedly a suspicious package somewhere north of the Park, and asked if he could continue south to be farther away. The NYPD officer just told him to move behind the metal barrier. Plaintiff responded “I am already behind the barrier, what do you want me to do?” In response, officer Grodnick grabbed and arrested the Plaintiff, charging him with Penal law 195.05 and 240.20(6). Grodnick and police captain Traynor falsley claimed in the complaint that Traynor asked the Plaintiff to move four times and he refused. The officers also falsely stated that the Plaintiff interfered with an ongoing police investigation and, after refusing to move, told officers “this is my park.” Finally, on November 27, 2011 near Zuccotti Park Plaintiff saw that Defendant’s Winski, Det. Jose Cabrera, Defendant Manning, and other officers detained someone on the sidewalk. When walking past, he gave the detained individual a pat on the back and was instructed to stand away from the individual. The Plaintiff complied. The man under arrest asked the Plaintiff to inform his spouse he was arrested. The Plaintiff sought to hear the name of the spouse and detective Cabrera and officer manning began a physical confrontation with the plaintiff and then seized, detained, and arrested him, charging him with Penal law 195.05. Officer Manning submitted false statements saying that the Plaintiff repeatedly stepped between the officers and the arrested individual. An unnamed NYPD officer grabbed at plaintiff's shirt without prior warning, and plaintiff then complied with Deputy Inspector Winski's order and began to walk away from unnamed NYPD officers. One or more of the officers then grabbed plaintiff, picked him up, carried plaintiff over the tarp on which he had been sitting, and then dropped forced plaintiff's face into the ground beside it. The unnamed NYPD officers then pinned plaintiff to the ground, prevented him from breathing, ignored his pleas, and refused to allow him treatment for his asthma. Unnamed defendant NYPD officers placed their knees and full body weight into plaintiff, with at least four NYPD officers placing their full body weight on plaintiff. One unnamed defendant NYPD officer started punching plaintiff, and another placed painfully tight plastic flexi-cuffs around plaintiff's wrist. Plaintiff was denied access to an inhaler for a long interval as he experienced an asthma attack, and suffered severe mental anguish and pain. NYPD agents raided the plaza and the Plaintiffs were arrested. In the course of their arrest, the Plaintiffs were harmed and mistreated. Plaintiff Carter’s arm was twisted by one officer while another officer kicked him in the abdomen several times. Other officers placed him face down in the ground and handcuffed him with his hands behind his back. Carter told the officers that his handcuffs were hurting him and the officers did not respond. Officers lifted Carter off the ground and dropped him on the sidewalk, where he was left lying for approximately thirty minutes. Officers then placed him face down on the floor in the aisle of the bus, where he remained for approximately two hours. Carter continued to request that his handcuffs be loosened and received no response. Carter also requested assistance in moving to an empty seat, which police ignored. Carter’s cell phone was lost or destroyed during the incident. Officer Ahmed was involved in injuring Carter. Plaintiff Castillo was hit with a batton by an officer and grabbed by his shirt/collar area and forced to his feet. He raised his hands and said he was not resisting arrest and an officer threw him to the ground, rammed his knee into his back, and handcuffed him. Another officer stepped on his face and pushed his head into the concrete with his foot. His handcuffs were placed so tightly that he experienced numbness in his hands for month and had marks on his wrists for approximately three months. Officers Rodriguez was one of the officers personally involved in injuring Carter. Plaintiff Greenspann was injured in the course of his arrest by officer LI\n\nPlaintiff Guest was approached by at least five officers and several of the officers grabbed his arm, thumb, leg, and elsewhere on the body. He was placed face down in the ground and handcuffed tightly in plastic flexi-cuffs. He complained that the cuffs were too tight, but no officer fixed the cuffs. At least two officers, including Officer Bovell, threw Guest head-first into the bus. They dragged him down the row of seats, banging his head on each seat, and threw him into a seat. Later, two officers picked him up and dragged him up the stairs to the back of the bus, intentionally hitting his head on each stair. Officer Ahmed was also personally involved in injuring Guest. Approximately five officers approached Hintze from behind. Several officers applied pressure to Hintze’s neck and clavicle areas and put their fingers in his ears. Several officers pulled him to the ground and on his back while Hintze was wearing a 20 pound backpack. Officers flipped him over onto his face and chest and stomach. An officer pressed his knee into his cheek and officers handcuffed him and threw him over a large stone bench, where he was left face-down for some time. He was carried to a holding pen and then pushed onto a bus. Hintze asked multiple times for his handcuffs to be removed because they were too tight and caused him pain. Eventually, officer LI replaced the plastic handcuffs with metal handcuffs, but again placed them on too tight. An officer approached Plaintiff Waller from behind and tried to lift her off the ground by placing her hands on Waller’s hair and the back of her scarf, pulling on her hair and choking her. Waller said “Please don’t hurt me, I will comply with you.” An officer grabbed her and she was taken out of the park and handcuffed. She asked for medical attention and received no response. She was shoved on to a bus and hit her chest. She asked to use the restroom and was not allowed to. She stayed on the bus for several hours before she was left in a cell at the precinct. She asked what charges would be brought against her and received no response. She started singing in her cell and an officer threatened to tase her or bring her to the hospital if she did not stop. Officer LI was personally involved in injuring Waller. Plaintiff Sharkey was grabbed by an officer and hit on the head and arms with a baton. Other officers grabbed him and forced him to the ground, twisted his arms behind his back, and handcuffed him. He was placed on a bus and an officer tightened his handcuffs. Officer Galgano was one of the officers involved in injuring Sharkey. Smith was grabbed by his shoulder and jacket and several officers dragged him about ten feet on the ground, placed him on the sidewalk, and handcuffed him. One officer kneeled on his back and placed his weight on his back. An officer pushed his head into the pavement. He was eventually bussed to the precinct. As Plaintiff walked away, an unknown PO directed Plaintiff to turn around and walk back. Plaintiff then walked past Deputy Inspector Winski who grabber her wrist and slammed her face into a car. Deputy Inspector Winski, Lieutenant Frank Viviano, Sergeant Brian Byrnes, and a fourth unknown officer then held Plaintiff down on the hood of a car and placed handcuffs on her, which were tight and caused Plaintiff pain. Sergeant Byrnes then walked Plaintiff, holding her arms in a painful position, to a police vehicle.
