Plaintiff had recently got into an altercation with a neighbor prior to the police arriving. PO Szot and Miah questioned and requested plaintiff's identification and plaintiff said she needed to get it from a friends car. Szot and Miah allowed her to do so, and as plaintiff walked down stairs to get her ID she noticed the aforementioned neighbor and 15 other police officers which included PO Miguel Perea, PO Szot; PO Daniel Rangel, Police Sergeant Jose Martinez and PO Christian Valencia. PO Perea unexpectedly slammed plaintiff into a wall with excessive force and then handcuffed her with excessive tightness; plaintiff was then removed from the building and taking to a local housing police precinct. Female John Doe Officer pat frisked plaintiff in a restroom at the precinct. John Doe Female NYPD Sergeant walked in after approximately ten minutes and moved some hairs from in front of plaintiff's face to which plaintiff responded by saying she does not want to be touched. John Doe Female Police Sergeant grabbed plaintiff, who was still rear cuffed, and threw her against a wall with excessive force, verbally abused plaintiff by saying \"who the fuck do you think you are\" and \"this is my precinct\", and purposely pulled plaintiff's arms back to cause pain. Plaintiff screamed in pain and told the sergeant that there was video recording in the precinct and the sergreat responded by saying \"shut the fuck up,\" \"who the fuck do you think you are you stupid black bitch,\" and the like. The verbal abuse was going no for so long that Police Sergeant Jose Martinez appear to pull John Doe Female NYPD Sergeant aside to tell her to stop with the abuse. Plaintiff also alleges that PO Perea and Valenica were present and failed to intervene when all the abuse was happening. Female Doe Sergeant told plaintiff she was getting put through the system instead of receiving a desk appearance ticket because plaintiff was a \"stupid black bitch\" and was being an asshole. Plaintiff requested to be taken to a hospital and was placed in excessively tight leg shackles before being transported to the hospital. During the evening, Plaintiff's roommates, were involved in a physical altercation. Plaintiff was not involved in the fight.\n\nWhen police arrived, Officers entered Plaintiff's apartment without a warrant. SZOT stated that Plaintiff was not going to record them. Szot ordered AVALIES to arrest Plaintiff after he attempted to record the police search within his apartment. Officer Carlos Aviles forcefully grabbed Plaintiff, slammed him against the wall, and applied handcuffs tightly, causing pain. Plaintiff was detained at PSA 8. While in custody, officers unlawfully searched the apartament. Williams drafted a Criminal Court Complaint of their account falsely stating that Plaintiff committes numerous cirmes rellated to posession of a controlled susbtance.\n\nOn September 5, 2017, at 3:30 p.m., while in costody, Officer Heinz assaulted Plaintiff when he was making a call to his mother. HEINZ then stated, \"you don't make the rules around here,\" and suddenly swept Mr. Desane's feet, grabbed his head and slammed him face first into the metal bars of the holding cell and kneeing him, resulting in lost of consciousness, severe injuries requiring hospital treatment. HEINZ is taller than Plaintiff and weighed at least 50-60 pounds more than Plaintiff on the date of the incident. \n Numerous other officers, including JOHN DOE PHONE CALL, and several female officers, including SZOT, were present in the vicinity of the holding cell area and had the time and opportunity to intervene to prevent HEINZ's unlawful use of force against Mr. Desane, but chose not to. There were at least two cameras in the holding cell area that video recorded HEINZ brutally beating Plaintiff.\n\nAt the hospital, Plaintiff underwent aCT Scan, had to have an emergency procedure performed to the wound above his right eye, and received approximately 15 stitches to close the laceration above his right eye. \n\nDefendant officers also charge Plaintiff of assult of a police officer, harassment and obstructing govermental administration, falsely alleging that Plaintiff attacked police defendants.
