Officer E. Cruz, Michael Fortunato, and \"John Doe,\" arrived and arrested them both. Officer Fortunato told Mrizalde at the precinct \"We just want the truck.\" Both were charged with Unathorized Use of a Vehicle. Both cases were dismissed January 2020. All charges in the case were subsequently dismissed in Plaintiff's favor on January 30. Then, on March 17, 2018, at approximately 11:00am, Plaintiff was walking on Cornaga Avenue in roughly the same location when he was again unlawfully stopped by the same Defendant officers, arrested, and taken to the 101st Precinct where he was questioned about the same claims/charges that had led to the January 13th arrest and which had been dismissed. Plaintiff was subsequently taken to Queens Central Booking, then to the 100th Precinct located at 9224 Rockaway Beach Blvd. the same day, again questioned about the same charges, then returned to the 101st Precinct where he remained until March 18th at 8:00pm at which time he was taken back to Queens Central Booking. Plaintiff was released from Queens Central Booking at 11:00pm on the 18th.
