Roa, for moving a planter box that had been placed in his usual spot for his cart. Earlier that morning, six NYPD officers had come by and told Plaintiff he could place his pushcart there and move the planters. An hour later, other officers arrived and told him he needed to move his cart and put the planters back. Plaintiff refused, and officers arrested him, kicking his lefts open and hurting his back. They then cuffed him and placed him in the car. P.O. Roa removed Plaintiff's wallet and keys from his pockets, hooked his cart to his van and drove it to the corner of the street. After 45 minutes, defendants released Plaintiff and warned him never to return to the vending location. Plaintiff was later treated at a hospital for a handcuff-inflicted laceration.
