Protestors arrived at the park and shouted aggressively at Plaintiff, who shouted back before leaving. Plaintiff soon got into a dispute with more protestors on or around Fifth Avenue. Captain Treubig approached Plaintiff from behind and grabbed him. Captain Treubig then punched Plaintiff in the head. Lt. Jurgens and P.O. Williams, Rivera, and Cambria arrived on the scene, forcing Plaintiff to the ground and holding him down by his arms, legs, and upper body. While Plaintiff was on the ground, Captain Treubig and the other officers repeatedly punched Plaintiff in the head and torso. P.O. River kicked Plaintiff multiple times in the ribs. Plaintiff was handcuffed extremely tightly, causing pain in his hands and wrists, and his requests to have them loosened were ignored. Bleeding from his nose and mouth, Plaintiff was taken by ambulance to the hospital and treated for his injuries. Plaintiff suffered a broken nose, burst lower lip, chipped tooth, blood in his eyes, abrasions, contusions, swelling, pain in his left knee, back , and ribs, scarring on his wrists, and a loss of sensation in both hands. Several hours later, Plaintiff was taken to Central Booking, where he was charged with assault and resisting arrest.
