An undercover police officer approached Zhuang and started a conversation (Zhuang did not know this was an officer). The officers violently arrested Mr. Zhuang and took him to the precinct. At the precinct, the officers falsely informed employees of the Queens County District Attorney’s Office that they had observed the plaintiff engage in drug-related offenses and prepared false paperwork, including an arrest report, to that effect. However, the officers never observed Zhuang engage in unlawful conduct. After spending approximately twenty-four hours in custody, Mr. Zhuang\nwas arraigned on the false charges and released on his own recognizance. During his extended prosecution, Mr. Zhuang participated on behalf of the government in the perjury and flaking (spelling?) prosecution of a defendant officer, and ultimately moved successfully for the dismissal of the charges.\n\nDefendant Anderson was working as the “ghost” at the time Mr. Zhuang\nwas arrested and has admitted in sworn testimony that he was aware of Mr. Zhuang’s innocence. However, Anderson took no action to intervene in the violation of Mr. Zhuang’s constitutional rights. All charges were dismissed on January 28, 2015. Defendants took law enforcement action with regard to Mr. Zhuang based solely on his actual and/or perceived national origin, race and/or ethnicity.
