Officers (unnamed) believed they had guns and drugs and searched both the car and their persons but did not find anything other than a pocket knife. All four were taken to the 123 precinct in separate cars, where they were searched again. Plaintiff was kept at precinct all night and did not see a judge until the next day at 4:30pm. Plaintiff was charged with possession of the pocket knife, even though another passenger claimed it, and was released on his own recognizance. Plaintiff was later incarcerated for a different offense, but was never taken to court or informed about the earlier charges.
