PO Daniel Cruz and John Zizzo passed through the gated area of the residence and stood before them and began harassing them and demanding to know why they were there and asked for ID. After plaintiff stated he did not have identification and advised that he lived at the location, the officers grabbed Plaintiff, punched him in the face with a closed fist, and then repeatedly sprayed him in the face with pepper spray. Plaintiff was arrested, handcuffed and transported to the 115th precinct in a patrol car. PO Brian Marrin as supervising officer evaluated the arrest paperwork and charged Plaintiff of criminal trespass inside his own residence. \nPlaintiff was arraigned in Queens Criminal Court on October 4, 2012. Plaintiff entered a plea of not guilty, was released on his own recognizance, and the case was adjourned. At the time of release Plaintiff had been in custody for approximately 28 hours.
