The police were informed that those objects belonged to Tertullien and the Plaintiff was never in possession of any illegal objects, but the officers handcuffed and arrested him regardless. The Plaintiff was placed in a cell with other male prisoners in the 43rd Precinct in the Bronx where he was strip searched and nothing illegal was found. He was held there for several hours before being transported to Bronx County Central Bookings. Then on February 11th, the Office of the Bronx District Attorney declined to prosecute the Plaintiff and he was released from custody. The complaint states that the Plaintiff has suffered physical and emotional injuries due to the incident.
