Plaintiff immediately stopped his behicle and offered defendant Singh his license and registration, but was ordered to exit the vehicle by defendant Singh. After plaintiff briefly questioned defendant Singh as to why he was being ordered to exit his vehicle, defendant Singh opened plaintiff's driver-side door, grabbed plaintiff, pulled him from the vehicle, and ordered him to the back of the vehicle. Plaintiff complied and walked to the rear of the vehicle, where defendants Singh and Grace grabbed plaintiff, slammed him to the ground, punched him in the face, placed an arm around his neck, and pepper-sprayed plaintiff's eyes and ears, before handcuffing plaintiff. Plaintiff was then transported by other NYPD officers to the 41st Precinct, where he was subjected to a strip search despite lack of suspicion for carrying weapons or contraband. During the strip search, plaintiff was ordered to cough, and when he did not was punched in the stomach, causing him to slump over. Defendants Singh and Gracie fabricated allegations that plaintiff was driving recklessly, drove in reverse at high speed when stopped, and refused to exit his vehicle before pushing defendant Singh and running to the rear of his vehicle.\n\nDefendants also claimed the plaintiff wrestled with the defendants, struck them, and tried to grab Officer Grace's gun, grabbed and tossed an officer's radio, and physically injured both arresting officers. Due to the false allegations, plaintiff was arraigned on nine felonies and eleven misdemeanors in Bronx Criminal Court and a Bronx County Grand Jury then voted a ten-count indictment including counts of assault, resisting arrest, and attempted criminal possession of a weapon. Plaintiff was forced to appear in Bronx County Supreme Court for the next 22 months until November 20, 2017, when a jury acquitted plaintiff of all charges. The three officers had no warrant or probable cause of criminal activity to search and arrest the plaintiff. The officers effectuated an arrest based solely on the plaintiff's age and/or race. Without any legal justification, the defendants touched, grabbed, handcuffed and seized the plaintiff in an excessive manner while transporting him to the police station in Bronx County. \n\nUpon arriving at the station, the plaintiff had his fingerprints and photographs taken as part of the process for a criminal arrest. The officers continued to touch, assault, strip search, humiliate, and handcuff the plaintiff while in the station. At one point, each of the defendants battered the plaintiff by initiating offensive bodily contact with his head, back, neck, and limbs. At all relevant times, none of the defendants had probable cause of the plaintiff's criminal activity. As a result of this false arrest and malicious prosecution, the plaintiff suffered shame and embarrassment within his community, loss of enjoyment of life, and fear for his safety.
