In the defendant's statement, he observed the plaintiff display and offer for sale more than twenty buttons without displaying a vendor license. The defendant approached the plaintiff asking if a nearby table containing certain goods for sale was her, after the plaintiff said no and that it belonged to another person, Denver Bannister. Plaintiff was taken to the precinct where she was held for approximately six hours, and released with a desk appearance ticket. The defendant falsely informed employees of the NY District Attorney's office that they had observed plaintiff commit crimes and/or offenses. The plaintiff was convicted of one count of each of vending without conspicuously displaying a license and unlicensed general vending, and was sentenced to time served on each count.
