Roberts had chocolates to sell on the street, to raise funds for a school trip for her son. Solomon needed to use a restroom. Roberts directed him to a nearby store. She told him she would remain where she was so he could find her when he returned. Solomon has a processing disorder, difficulty memorizing more than simple directions, and becomes extremely agitated if he encounters unexpected changes in direction or deviations from routine. After Solomon left, a woman in plain clothes approached her and inquired about the chocolates. Roberts responded they cost one dollar. The woman told Roberts to turn around, and placed handcuffs on her. The woman turned out to be a police officer. Defendant did not read Roberts her rights or a Miranda warning. Roberts explained she was waiting for her son, who was still using the restroom a block away. Roberts insisted her son, given his condition, would be unable to find her if she was taken from her current location and cause him distress. Defendant ignored Roberts and moved her to a barricade area in the street. Roberts explained her son would not be able to find her since she moved from the place she previously stood, and this was causing her, and her son, considerable anxiety. Roberts was taken to the Midtown South Precinct. Roberts repeatedly requested to use her phone to call her son. Police put her in a holding cell and did not permit her to make a call for several hours. When allowed to call Solomon, he was hysterical and spent several minutes crying. He said he spent the past few hours searching for his mother and wondered why she abandoned him.
