When the young man noticed that the Plaintiff was observing the assault, the young man threatened the Plaintiff. The young man then told his friends that the Plaintiff \"needed to mind his own business\" or words to that effect. The young man and his friends swarmed the Plaintiff and threatened to shoot him. One of the assailants showed the Plaintiff a gun before fumbling it into his pants. The Plaintiff shot at and grazed the young man with a bullet. The plaintiff then called 911 and reported the shooting. \nAt the relevant time, the Plaintiff was licensed by the City and State of New York to carry a concealed firearm. The Plaintiff provided the documentation evidencing that license to the police. Based solely on the information provided by the Plaintiff in which he described his fear and self-defence actions, the Plaintiff was charged with Assault in the First Degree and two (2) counts of Assault in the Second Degree. The NYPD, and in particular Officer Joseph Garofalo, arrived at these charges by intentionally manipulating the Plaintiff, by suppressing portions of his statement which were exculpatory, by presenting \"fraudulent, false and perjurious information to the prosecutor.\"   The Plaintiff was held in jail for \"a couple of days\". The Plaintiff's gun license was subsequently revoked. The criminal charges were ultimately dropped.
