The officers lacked probable cause or reasonable suspicion to justify their actions, searched the plaintiff without legal justification, and did not find any contraband. At no time was plaintiff in possession of any illegal drugs, weapons, or contraband The plaintiff was transported to a precinct, where he was photographed, fingerprinted, and detained. Without any probable cause or legal justification or indication of emotional disturbance or danger to himself or others, the defendants transported the plaintiff against his will to Hospital, where he was further restrained and subjected to unlawful shackling attempts. After being held for several hours, the plaintiff was discharged and subsequently transported to Central Booking.\n\nDefendant Officer Thomas falsely claimed that the plaintiff assaulted her at the Hospital, resulting in serious injuries. Based upon the false, misleading, and incomplete information provided to the DA by the defendant officers and sworn to by the defendants in the criminal court complaint, defendants maliciously initiated a prosecution against plaintiff without probable cause which led to his indictment on charges of Assault in the 2nd Degree. The plaintiff spent several days in custody and appeared in court multiple times before all charges were dismissed on February 27, 2014. There were violations of the plaintiff's constitutional rights, including unlawful stop, search, and arrest, false imprisonment, malicious prosecution, and denial of a fair trial. The plaintiff suffered physical, emotional, and psychological injuries due to the defendants’ actions.
