Plaintiff was lawfully present on the sidewalk in the vicinity of the intersection of Morningside Avenue and Manhattan Avenue when Defendants, officers of the New York City Police Department, Mahon and John or Jane Doe 1-10 appeared and approached and stopped Plaintiff without probable cause, reasonable suspicion, valid search or arrest warrant or any legal justification. Defendants then illegally questioned Plaintiff and falsely accused him of a criminal offense. Defendants next seized Plaintiff's person with their outstretched hands aggressively grabbing him about his head and body before unlawfully searching his person by rifling their hands in and out of Plaintiff’s clothing and personal belongings, without probable cause, reasonable suspicion, valid search or arrest warrant, or any legal justification whatsoever as to the commission of a crime on the part of Plaintiff. No contraband was found from Plaintiff's person or belonging to indicate that he committed any crime. Plaintiff then explained that he was on the way to the nearby precinct to exchange a handgun for money through the NYPD buyback program. After Plaintiff told Defendants that, Defendants grabbed Plaintiff about his body and extremities before violently contorting his arms and\nwrists behind his back and applying excessively tightened metal handcuffs, causing plaintiff to experience significant pain and discomfort. Plaintiff complained to Defendants and requested that the handcuffs be loosened, but Defendants ignored plaintiff’s pleas. \n\nThen, Defendants placed Plaintiff in a police vehicle and transported him to the NYPD 28th Precinct against his will where he was was fingerprinted, photographed, searched or strip-searched, questioned as to his pedigree, illegally interrogated without presence of counsel and being Mirandized, and illegally detained for a length of time before being transported to Central Booking where he illegally detained again for a length of time until he was transferred to Manhattan Detention Complex, where he was forced to endure all the attendant indignities associated with long-term incarceration until his release on May 15, 2020. The criminal prosecution initiated by Defendants, was terminated in Plaintiff’s favor when all adverse charges were unconditionally dismissed and sealed on or about May 3, 2021.
