The Plaintiff complied but was thrown against their vehicle and searched. The Defendant officers found a bottle of prescription drugs prescribed to the Plaintiff. Despite having explained to the Defendant Officers that the pills were legally in his possession, he was arrested for possession of a controlled substance and placed in excessively tight handcuffs. The Plaintiff was then held in a police van for several hours in the hot day without AC. When he was finally transported to the precinct he was walking slowly on account of a previous leg injury. He was slapped numerous times in the head by an unidentified NYPD officer for walking too slowly. The Plaintiff asked to go to the hospital because of a condition which leaves him susceptible to internal bleeding, but was denied. Defendant Officers provided false information to the District Attorney in order to have him charged with Possession of a Controlled Substance. The Plaintiff spent approximately 31 hours in custody prior to arraignment. When the Plaintiff produced his valid prescription, all criminal charges were dismissed.
