The plaintiff was struck by another vehicle that veered into the bike lane, causing him serious injuries. Despite the fact that pedal-assist e-bikes do not require a driver's license, the defendants falsely accused the plaintiff of operating a motor vehicle with a suspended license. They violently contorted his hands behind his back and applied tight handcuffs, ignoring his obvious injuries from the accident. The defendants conducted an illegal search of the plaintiff by rifling through his pockets and patting him down. Those present but not actively participating failed to intervene. The plaintiff was transported to Lincoln Hospital for treatment while handcuffed and then taken to an NYPD precinct, where he was scanned, searched, and confined to a cell. He was subsequently moved to Bronx County Central Booking and wrongfully detained for three days. Defendant Lopez fabricated evidence and maliciously filed a criminal complaint against the plaintiff for operating a vehicle with a suspended license. All charges were dismissed in favor of the plaintiff on October 16, 2020. When the plaintiff attempted to retrieve his e-bike, he was advised it had been destroyed by the NYPD.","documents":[{"url":"https://iapps.courts.state.ny.us/nyscef/ViewDocument?docIndex=lEIhZBuQP3Jp6crndnLyAA==","type":"complaint"}]},{"name":"Paulino, Franklin, et al. vs City of New York, et al.","start_date":"2020-02-20","disposition_date":"2020-11-20","payout_amount":45000,"disposition":"Settlement","docket":"022365/2020E","court":"Supreme Court - Bronx","officer_name":"Lopez, Cynthia","summary":"On December 12, 2019, plaintiffs were lawfully in the vicinity of East 163rd Street and Kelly Street, when defendant police officers, without any probable cause or legal justification, summarily stopped, searched, grabbed, assaulted, battered, and detained plaintiffs with excessive force.
