Plaintiff then handed the teller $500 and their credit card and asked for the teller to use the $500 to pay down the credit card balance. Plaintiff then asked to also make a withdrawal, she handed a note to the teller asking the teller to count the bills quietly. Other bank employees interpreted these actions to mean that the plaintiff was attempting to rob the bank (she was very much not) and called the police. Police arrived including defendant officer Burgio and they arrested the plaintiff, confronting her with guns drawn, using excessive force to handcuff the plaintiff. Plaintiff was taken to a police precinct. Defendants then claimed that a warrant was out for plaintiff's arrest as they had recently received a 911 call alleging that someone was vandalizing a bicycle. Defendants thereafter searched plaintiff's backpack and, despite finding no contraband, arrested plaintiff. Plaintiff subsequently spent several days at Rikers Island, where he was denied basic necessities and access to his medication.
