Defendant followed Plaintiff and his classmate onto the area beyond the turnstile, stopped them and demanded identifications. Plaintiff complied and presented his credentials to Defendant. Plaintiff's classmate inquired as to the reason for the stop before providing credentials. Defendant seized Plaintiff and his classmate's credentials and seized Plaintiff’s classmate and rear-cuffed him. Plaintiff with cellphone in hand, immediately began to record the stop and seizure of Plaintiff’s classmate. Defendant removed Plaintiff’s classmate from beyond the turnstile towards the subway exit, and plaintiff followed still recording. Defendant with a running start, charged and tackled plaintiff to the ground, knocking his cellphone from his hand, then dragged him across the ground and arrested him. Plaintiff was taken to a local precinct. There, defendant falsified reports that Plaintiff had physically interfered with the arrest. Defendants deleted the entire photographic and video catalogue from plaintiff's phone to destroy evidence. Defendant swore out a criminal complaint and maliciously prosecuted Plaintiff.
