Plaintiff was accosted by NYPD Officer Christopher Dellavalle and several unidentified police officers. Without probable cause, they questioned Plaintiff, handcuffed him so tightly as to cause lacerations, and arrested him. After Plaintiff was handcuffed, several officers began violently assaulting him. They kicked Plaintiff’s legs out from under him, causing him to fall to the ground, brutally kicked him in the legs, and stomped on his left foot, causing it to break in 3 places. They repeatedly punched Plaintiff about his body and sat on his back until he could no longer breathe. Plaintiff was dragged to a police vehicle and taken to the precinct, confined to a cell, and charged with several crimes. The officers provided false information to the New York County District Attorney’s Office, on the basis of which a prosecution was initiated. Plaintiff spent approximately 200 hours in custody, including 1 week in the hospital, during which time he was shackled to the hospital bed. Plaintiff was arraigned on June 5, 2014, and was released on his own recognizance. After several court appearances, all charges against him were adjourned in contemplation of dismissal on September 10, 2014.
