Plaintiff went outside to tell the 3rd party to get off his bike and leave the location, to which the 3rd party responded by pointing a screwdriver at Plaintiff, threatening him, and telling him “this is my bike now.” Then, the 3rd party got off the bike and attacked Plaintiff. Plaintiff defended himself by hitting the 3rd party with a bat and then called 911 for the police. A few minutes later, the police arrived and spoke with Plaintiff. The police watched the video surveillance, which captured the entire incident with the 3rd party. Nevertheless, and despite this exculpatory evidence, Defendant Officers still arrested Plaintiff and restrained him with metal handcuffs. During his time in custody, Defendant Officers falsely communicated, or had communicated on their behalf, allegations that Plaintiff had committed a crime to Kings County District Attorney’s Office, to wit: Assault in the Second Degree and other related charges.
