The occupant of the rented vehicle ran away and never returned the vehicle to Hertz. The Plaintiff contacted Hertz and was in an ongoing negotiation/dispute with Hertz and Hertz’s insurance company, ESIS, regarding the proper amount of payment for the damage. The vehicle was in storage while the Plaintiff and ESIS negotiated, but on November 2017, a ESIS representative informed the Plaintiff that the vehicle was not reparable and the storage fee was mounting. On November 27, 2017, an ESIS representative informed the Plaintiff that because the storage fee was mounting, they removed the company removed the vehicle from storage and paid the storage fee without consent. The Plaintiff and ESIS continued to dispute the proper payment amount.  \n\nOn November 30, 2017, after unsuccessfully coming to an agreement with the insurance company, the Plaintiff went to report his vehicle as stolen because it was removed from storage without his consent. However, he was told he had to call from the body shop and couldn’t receive a stolen car report at the precinct. On December 1, 2017, he returned to the body shop and called 911. Police officer Gullo arrived at the scene and refused to file a police reporting, noting that the vehicle was not stollen and it was a criminal, not civil matter. December 4, 2017, the Plaintiff called the Queens County DA and spoke to an A.D.A. to file a stolen car complaint. The DA’s office also refused to file a stolen car complaint.
