Sergeant Mourad Mourad and Officer Jovaniel Cordova of the NYPD pulled up in an unmarked vehicle. After one of the officers loudly asked Kimani where his brother was, the officer then said \"You're not going to be nothing when you grow up. You're going to be just like your brother.\" Kimani then turned his back to the officers, and in an attempt to leave, tried to hop over a gate to a driveway. Defendants Mourad and Cordova stopped and seized Kimani by pointing their firearms. After Kimani got down on his knees and raised his hands straight up int he air, the named defendants shot Kimani several times. Rather than administer medical aid, defendant Hoder handcuffed Kimani behind his back and to a fence. Plaintiff Roxroy ran inside for cover, while Plaintiff Daveion froze on the stairs out of fear. The defendants then instructed plaintiff Daveion to get on\nthe floor started asking him where the gun was, to which he replied that he had no idea. However the defendant officers repeatedly told him to stop lying and placed him in handcuffs.  Meanwhile, the other defendant officers, kicked in the front door to plaintiffs’ home and ran inside with their guns drawn pointed at plaintiff Roxroy. Notwithstanding that plaintiff Roxroy was laying flat face down on the floor, and not a threat to the defendant officers or any other person, the defendant officers were standing and kneeing on him with so much weight. They asked him where the gun was and called him Mike.  Plaintiff Roxroy said he was not Mike, but the defendant officers refused to listen and as one of the officers kept applying pressure to plaintiff’s knee, another defendant officer kept hitting plaintiff in the head with the muzzle of the defendant officer’s gun. He was taken to the police car, when the defendant officers searched plaintiffs' entire home, trashing and destroying plaintiffs’ rooms and other rooms in the house. Eventually one of the defendant officer’s took the plaintiffs’ Id and came back a few minutes later and\napologized to plaintiff Roxroy, finally addressing him as Mr. Hill and stating that they had made a mistake, and the he was going to have plaintiffs released in a few minutes. \n\nHowever, later they were not released but instead the defendant officers booked and charged the plaintiffs with menacing in the 2nd degree with a weapon, amongst other criminal charges. They were later transferred to the criminal court. In both places, they were detained without any food, drink or access to a functional restroom facility. Defendants made false statements to the DA, and Plaintiffs remained in the detention of the defendants for a second day, before the plaintiffs were brought before a judge of the criminal court.
