Demitress noticed an unmarked vehicle tailgating him. The road made it difficult for the vehicle to pass, so he slowed as he approached an “Access-a-ride” vehicle double parked in the land up ahead. When he slowed, the tailgating vehicle blew its horn. After passing the access-a-ride, he pulled to the far right side of the vehicle, expecting that it would give the tailgating vehicle a chance to pass him. Instead, the tailgating vehicle also pulled over and three or four defendant officers in plainclothes got out of the vehicle, including Defendant Saitta and Defendant Cruzdo. The defendants pulled Plaintiffs out of their vehicle and searched it, without responding to Plaintiffs’ questions of why. They also searched the Plaintiffs clothes, obligating Shavone to pull his pants open so they could search for contraband. They then arrested the Plaintiffs. \n\nDefendant Det. Dominick J. Vasturo falsely told the DA Office that the Plaintiff’s vehicle had a broken brake light and the officers attempted to pull them. He further said that the failure to pull over triggered a five-block car chase with lights and sirens, that the officers saw Shavone pass something to Demitress, and once the vehicle was stopped Demitress threw twists of crack cocaine out the window.
