Plaintiff was falsely prosecuted, and the criminal proceedings were terminated in favor of Plaintiff on, or about, December 3, \n2020, when all chargers were unconditionally dismissed and sealed on the merits. Bradley indicated that he wanted to leave with Mr. Joseph, but Ms. Estrada did not want Bradley to leave. After unsuccessfully trying to grab Bradley away, Ms. Estrada proceeded to call 911, telling the police that \"this man is trying to leave the park with her son.\" The police did not respond to the first 911 call. \n\nMs. Estrada and Ms. Nieves' argument escalated into a physical confrontation, where Ms. Nieves suffered a cut that caused her to bleed as a result. Ms. Estrada then called 911 the second time, this time stating that Mr. Joseph pulled out a gun and pointed it at her and Bradley. The police appeared soon after and placed Mr. Joseph in handcuffs. After searching the area and finding no weapon or corroborating witnesses, the police released Mr. Joseph. \n\nWhile Mr. Joseph was being arrested, someone called his mother, Michelle Clarke, and informed her of the arrest. When she arrived at the park and inquired as to the status of her son, she was told by NYPD Officer Toribio to shut her mouth. When she asked him for his name and badge number, he put his chest into her face, pushed her into the RMP, and placed her under arrest. After Mr. Joseph asked why his mother was being placed under arrest, the officers turned him around and placed him back under arrest. He was initially incarcerated for about a day, but was incarcerated by parole as a result of this case later for 115 days. When the police arrived, Plaintiff attempted to talk to the officers about what was taking place. Officer Andres Toribio told Plaintiff to shut up. Plaintiff then asked Officer Toribio for his name and badge number. Officer Toribio shoved his chest into Plaintiff's face and pushed Plaintiff into the police car. Without reason or justification, Officer Toribio arrested Plaintiff in front of her grandson and family, causing Plaintiff emotional distress. Plaintiff was taken to the 77th Precinct where she was incarcerated for over an hour before she was released. Plaintiff received a summons which was later dismissed on November 2, 2018. Toribio and P.O. Germain, came the residence of Plaintiff Mr. Azurdia when he had failed to pay his taxi driver.  When Plaintiff Azurdia opened his door, one of the Defendant Officers immediately fired his gun at, and hit, the Plaintiff Azurdia's dog several times. Two Defendant- officers placed Plaintiff Azurdia in handcuffs and transported him to the 77th Precinct. The Plaintiff's dog died as a result of the bullet injuries it had sustained. Plaintiff Azurdia was charged with Theft of services.
