Earlier that day, Plaintiff was assaulted by her roommate, to which Plaintiff called 911. Defendants arrived and observed Plaintiff’s injuries, but the assailant fled so Defendants instructed Plaintiff to call again if the assailant returned. That night, the assailant returned, prompting Plaintiff to call police again. Defendants returned to the scene. Defendants ignored exculpatory information proffered by Plaintiff, accused Plaintiff of assault, seized her with their outstretched hands grabbed about her person, and searched her person by rifling their hands through her belongings. Defendants searched Plaintiff’s person by shoving their hands into her clothes and intimate areas. Defendants grabbed Plaintiff about her body before contorting her arms behind her back and applied metal handcuffs in a tight fashion. Plaintiff requested the handcuffs be loosened, but defendants ignored plaintiff’s pleas. Defendants placed Plaintiff in a police vehicle and transported her to the 32nd Precinct where she was strip-searched with cavity inspection, interrogated without counsel and being Mirandized. Plaintiff was transported to Central Booking. On June 7, 2023, plaintiff was released from custody, after arraignment. Defendant signed a criminal complaint to the DA, and affirmed allegations against Plaintiff.
