Defendant officers informed the Plaintiff that they had received a noise complaint from the Plaintiff's landlord who lives in the basement below them. A few days before, NYPD officers had come to the Plaintiff's home at around 6am in response to a noise complaint made by the landlord despite the Plaintiff's family being asleep. After Plaintiff finished speaking with defendant officers, plaintiff had closed the door of his apartment and began talking to his wife who had began crying in response to the stress of having officers come to their apartment during the night. Defendant officers had not actually left Plaintiff's residence after speaking to Plaintiff. Officers claimed that they had head children crying from outside and barged into Plaintiff's apartment. Plaintiff had pleaded with officers to leave his family alone, and was put into a headlock by an officer. Plaintiff had recently been in a car accident in which he had dislocated his shoulder. While plaintiff remained in a headlock, officers began to kick and punch Plaintiff throughout his body. A defendant officer threw Clorox bleach in Plaintiff's face and then proceeded to pull Plaintiff's sweater over his head so he could not see. Plaintiff was placed in handcuffs. While in handcuffs, defendant officer punched plaintiff with a closed fist approximately five times. A Defendant officer had told Plaintiff's wife to fill out a Domestic Incident Report against Plaintiff and threatened her that she would call the City's Child Protective Services to take her children away if she refused. As he left, he walked toward his motorcycle, when he heard someone yell \"put your hands up!\" Plaintiff turned to see a Hispanic male, who later identified himself as Defendant P.O. Colon, and an unknown female. Defendant Colon drew a firearm and pointed it at Plaintiff's face, and again shouted for Plaintiff to put his hands up. Defendant Colon aggressively grabbed the Plaintiff and handcuffed him. The handcuffs were tight, causing swelling an bruising, but Defendant ignored Plaintiff's request to loosen them.  Plaintiff asked why he was being arrested and Defendant Colon said that he would find out when the cops came and that he knew what he did. Approximately twenty minutes after the arrest, Defendants P.O. Veras, P.O. Vega, P.O. Guillen, Sgt. Genao, and P.O. John Does 1-10 arrived at the scene and Defendant Colon informed them that the Plaintiff was in possession of Defendant Colon's stolen motorcycle. One of the Defendant's asked Plaintiff for his identification and removed his handcuffs. The Defendants checked the license and registration and inspected the motorcycle, and they determined that the registration was appropriate and they did not identify the motorcycle as stolen. Plaintiff repeatedly asked the Defendants if he was free to leave and they repeatedly told him that he could not leave the scene. Defendants did not immediately release the Plaintiff from custody, and he was in custody for for approximately one hour in total. After approximately one hour, one of the Defendants informed Plaintiff that it was all a misunderstanding and he was free to leave.
