Plaintiff again asked for the location of her spouse and his property. PO Robert Hunter and others then confronted Plaintiff and told her to leave because they were \"sick of her mouth.\" Plaintiff declined to leave and was then grabbed by PO Rodney K. Hale, who struck her in the face. Plaintiff was then forcibly pulled backward down a flight of stairs. PO Hale verbally threatened to shoot two bullets into Plaintiff's head and twelve bullets in Plaintiff's mother's head. PO Bermaly Nunez was also involved in the incident. Defendants seized plaintiff’s person by grabbing him forcefully with their outstretched arms, and began to conduct an illegal search of Plaintiff's person in plain view of bystanders and his fellow employees.  Plaintiff then explained to Defendants that he had video surveillance of the incident in question, occurring approximately one week before said time, where it was alleged by a complaining victim that Plaintiff had assaulted them. Defendants then ignored the exculpatory information proffered by Plaintiff and formally arrested him. Plaintiff was transported to the 79th Precinct, where he was fingerprinted, photographed, searched, illegally interrogated without presence of counsel, and illegally detained for approximately 8 hours before being transported to Central Booking. Defendants P.O O HALE, MARFOGLIO, and JOHN DOES filed false paperwork with the DA charging Plaintiff with the criminal offense of Assault. Plaintiff was in the defendant’s custody at the Central Booking for more than 42 hours before being released from physical custody after his criminal court arraignment. As a result, Plaintiff was caused to be unlawfully detained over the course of approximately 3 days, until he was finally released from the physical custody of defendants on, or about, January 23, 2022.
