Defendant officers never observed plaintiff seated inside the crashed vehicle and were not told by any witnesses that plaintiff was seated there. Defendants physically restrained and removed plaintiff by rear handcuffing her very tightly, resulting in substantial pain and physical discomfort. Defendant officers then entered the car without consent, search warrant, or other legal authority and fabricated observations to justify their search, including presence of a firearm within the crashed vehicle that each defendant officer falsely purported to have observed in plain view from positions outside the vehicle. Plaintiff was thereafter transported to the 40th Precinct by grabbing and shoving her into a police transport vehicle. There, plaintiff was criminally processed and subjected to invasive bodily searches and illegal interrogation tactics with threats of a protracted criminal prosecution followed by a lengthy imprisonment if she failed to comply with defendants' demands. Defendant officer next forwarded fabricated evidence to prosecutors, suppress exculpatory evidence from the prosecutors. Officer Daniel Ryan then charged plaintiff with possession of the firearm. Officers Serrano and Ryan shared false information with the District Attorney, resulting in plaintiff's wrongful arrest. When Stuart testified, he failed to mention that he was shot by another police officer. Further, Officer Serrano fabricated testimony that he saw plaintiff holding the gun at the scene.
