Plaintiff has schizophrenia and was visiting family when his father became concerned and called 311, explaining to the operator his son needed help because of his mental health crisis. Defendants Officer Bernard and Trupia arrived at the scene, and because they did not speak Spanish, they were unable to effectively communicate with Plaintiff or his father. Plaintiff did not understand what the officers were yelling. Plaintiff was experiencing delusions that the officers were there to torture him, so,  due to his mental health crisis, grabbed a knife for safety. Even though Plaintiff was a substantial distance from Defendant officers, they opened fire on him within moments of encountering him. Defendants did nothing to de-escalate the situation or employ any other techniques to increase safety. According to the NYPD, Officer Bernard fired two shots and Officer Trupia fired give shots. The Defendant officers then handcuffed Plaintiff while be laid unconscious on the ground. \n\nPlaintiff was taken to the hospital where Doctors stated his immediate blood loss was so massive that he was in hemorrhagic shock, and he had an extremely slim chance of survival.
