The defendants' fabrication of the situation led the District Attorney's Office to charge the  Plaintiff with the Sale of a Controlled Substance in the Third Degree and the Plaintiff's detainment for 41 months until his release from prison on or about November 16th, 2017. Those defendants who did not touch plaintiff, witnessed these acts, but failed to intervene and protect plaintiff from this conduct.The individual defendant officers did not have an objective and/or reasonable basis to use any degree of force against plaintiff, since plaintiff was unarmed, compliant, and did not resist arrest.
